Attorney Profiles

Charles D. Roush

Chuck Roush was one of the founding partners of Roush, McCracken, Guerrero, Miller & Ortega in January, 1987. He is a native of Arizona who has been a trial lawyer here for over 36 years. He is regularly recognized as one of the best trial lawyers in Arizona in such publications as "Who's Who in the Law," "America's Best Trial Lawyers," "Phoenix Magazine," and others. He is a Fellow of the American College of Trial Lawyers and the International Society of Barristers, and a long-time member of the American Trial Lawyers Association. He was a judge of the Superior Court in Arizona for five years, and has continued to serve in that role as a judge pro tem in both trial and appellate courts in the State. He is admitted to practice before the State and Federal courts in Arizona, as well as the United States Supreme Court.

Mr. Roush represents only seriously injured people and people whose loved ones have been killed as the result of negligence or other wrongful conduct. A large portion of his practice is devoted to the trial of cases referred to him for trial by other lawyers. He regularly handles cases in the fields of medical and legal malpractice, product failures, serious automobile and trucking accidents, and construction-related accidents.

Robert D. McCracken

Bob McCracken is also one of the founding members of Roush, McCracken, Guerrero and Miller. He is a 1972 graduate or the University of Virginia School of Law. Since 1972 he has practiced law in Phoenix, representing individual clients and their families who have been seriously injured or harmed by the neglect of others. For over 30 years he has pursued the rights of such clients against such special interest groups as construction companies, hospitals, medical providers, trucking companies, banks, and insurance companies.

For the past few years Mr. McCracken has concentrated his practice in construction site accidents and insurance bad faith claims. In these areas, he has pursued the claims of workers who have been injured as a result of having been exposed to unsafe working conditions by both general contractors and subcontractors; and he has pursued the rights of individual insureds who have been subjected to unfair claim practices by their own insurance companies.

Peter A. Guerrero

Peter Guerrero is one of the founding partners of Roush, McCracken, Guerrero, Miller & Ortega. He is a 1972 graduate of Indiana University and has practiced law in Phoenix, Arizona, since that time. He is also a member of the Indiana and Montana State Bar Associations. Mr. Guerrero has been certified as a personal injury and wrongful death specialist by the State Bar of Arizona. Since he started practicing law in 1972, he has represented only plaintiffs in personal injury/wrongful death matters and now confines his practice to catastrophic personal injury/wrongful death cases. These cases include medical malpractice litigation where Mr. Guerrero has developed a special interest and expertise in cases involving birth injury and/or pediatric issues.

Because both of his parents were Mexican immigrants, and because he speaks Spanish, Mr. Guerrero's clientele, by choice, is almost exclusively Hispanic. Over the years, he has taken pride in representing members of Arizona's Hispanic community who have traditionally been under- represented in the justice system. He has obtained many multi-million dollar settlements and jury verdicts for his clients who have been catastrophically injured and takes pride in the fact that he has been able to provide comfort and financial support to ease the suffering of his clients.

Mr. Guerrero also takes pride in the fact that he and his firm have become the law firm most other Hispanic lawyers in Phoenix turn to when they need help in representing their Hispanic clients in complicated, catastrophic injury cases. These referrals were earned by reputation, since the firm has never advertised.

Jeffrey B. Miller

Jeff Miller is a specialist in personal injury and wrongful death law, as certified by the State Bar of Arizona. He limits his practice exclusively to the representation of clients who have sustained serious personal injury or have been damaged by professional negligence.

Mr. Miller is a magna cum laude graduate of Harvard, and received his law degree from New York University before moving back to Arizona in 1984.

Believing that seriously injured clients benefit from lawyers who are passionate about their cases, he only accepts cases in which he will have personal participation. His long term interest in assisting children led to his involvement in medical malpractice cases involving babies and children with such problems as cerebral palsy and other birth injuries, an area of practice shared with Pete Guerrero. As an experienced motorcycle rider, he has a special understanding of the issues which arise in motorcycle injury cases. He, along with Chuck Roush, is one of the few Phoenix lawyers to devote a substantial part of his practice to plaintiff legal malpractice cases. With a family background in construction, he also accepts construction litigation, frequently working with Bob McCracken on such cases.

Daniel R. Ortega, Jr.

Danny Ortega is a 1974 graduate of Arizona State University, and also received his law degree in 1977 from Arizona State University College of Law. For many years the senior partner of Ortega & Associates, P.C., Mr. Ortega is the most recent addition to the experienced ranks of Roush, McCracken, Guerrero, Miller & Ortega, joing the firm as a partner in 2003.

Mr. Ortega has a long and distinguished history, not only with respect to his law practice, but also because of his public service in the community. Mr. Ortega serves on the Board of Directors of the National Farmworkers Service Center. He also serves on the Board of Directors of the Los Abogados Hispanic Bar Association and is a member of the Stewardship Board for The Roman Catholic Church of Phoenix.

He has served on the Arizona Industrial Commission, the Phoenix Aviation Advisory Board, the Maricopa County Industrial Authority, the Maricopa County Commission on Trial Court Appointments and the Disciplinary Commission of the Arizona Supreme Court. He has also served on the Board of Directors of the Mexican American Legal Defense and Education Fund, National Counsel of La Raza, the Arizona Trial Lawyers Association, Valley of the Sun United Way, Arizona State Alumni Association and Chicanos Por La Causa, Inc.

Mr. Ortega's practice is concentrated on serious personal injury and wrongful death cases on behalf of his clients. He is fluently bilingual.

Marni F. Guerrero

Marni F. GuerreroMarni is a 2003 graduate of Arizona State University Law School, and was a 1999 graduate of ASU with a degree in Justice Studies. She has also studied in Mexico at the Instituto Tecnologico y De Estudios Superiores de Monterrey in the Masters Program of International Trade Law. She has also worked with the Legal Aid Foundation of Chicago in its Illinois Migrant Legal Assistant Program. She practices in all of the firm's areas of practice.

Gabriel V. Kory

Gabe V. KoryGabriel was raised in Nogales, Arizona; and received both his undergraduate degree and Juris Doctorate at Arizona State University. He also studied in Monterrey, N.L., Mexico at EGADE, Tec De Monterrey at the Instituto Tecnologico y De Estudios Superiores de Monterrey; attending the masters program in International Commercial Trade Law; and EIS Estudio Internacional Sampere in Madrid, Spain, earning a minor in Spanish. Gabriel is a member of the Association for Justice (previously the Association of Trial Lawyers of America); the Maricopa Bar Association, Arizona Trial Lawyers Association; and, the Nursing Homes Litigation Group (ATLA).

Gabriel is the newest edition to Roush, McCracken, Guerrero, Miller & Ortega, joining the firm in early 2006. Since his admission to the bar, he has developed considerable expertise in the area of nursing home abuse and neglect. Gabriel joins an already experienced practice whose collective goal is to obtain accountability on behalf of our state's most vulnerable citizens who have been abused and/or neglected in nursing homes, assisted living facilities, or group homes. Gabriel also represents victims and families whose loved ones suffer serious, life-altering injuries as a result of injuries occurring in Arizona nursing homes.

In addition to nursing home abuse and neglect litigation, Gabriel also represents wrongful death victims' and victims of medical malpractice, as well as other serious injury cases.

Frank X. Gordon, Jr.

The firm is honored to have Frank Gordon, former Chief Justice of the Arizona Supreme Court, of counsel to the firm. After a long and distinguished career as a jurist, Mr. Gordon provides mediation and arbitration services to lawyers within the state as well as to lawyers across the country.
